1. Scope<\/h2>

These General Terms and Conditions (GTC) apply to all contracts concluded for the purchase of goods, services, or other items (hereinafter referred to as \u201eGoods\u201c) via the online shop at the above URL, in the version valid at the time of contract conclusion. These GTC apply exclusively. Deviating GTC of the customer shall not become part of the contract unless the provider expressly agrees to them.<\/p>

2. Conclusion of Contract<\/h2>

2.1 The offers in the online shop represent a non-binding invitation by the provider to online shop visitors to submit an offer to purchase the goods offered in the shop.<\/p>

2.2 The order for the goods is placed via the provider's online order form. After selecting the desired goods, entering all required information, and completing all other mandatory steps in the ordering process, the selected goods can be ordered by clicking the \"Order\" button at the end of the checkout page (Order). By placing the order, the customer submits a binding offer to purchase the selected goods. The contract is concluded when the provider accepts the customer's offer. Acceptance occurs when the provider confirms the conclusion of the contract in writing or text form (e.g., via email) (Order Confirmation) and this Order Confirmation is received by the customer, or when the provider delivers the ordered goods and these goods are received by the customer, or when the provider requests payment from the customer (e.g., invoice or credit card payment during the ordering process) and this payment request is received by the customer; the decisive factor for the time of contract conclusion is the point in time when one of the alternatives mentioned in the first sentence occurs.<\/p>

2.3 Before submitting the order via the provider's online order form, the customer can review their entries and correct them at any time using the usual keyboard, mouse, touch, or other available input functions. Furthermore, all entries will be displayed again in a confirmation window before the binding submission of the order and can also be corrected there using the usual keyboard, mouse, touch, or other available input functions.<\/p>

2.4 The provider will store the contract text after the contract has been concluded and send it to the customer in text form (e.g., by email). The provider will not make the contract text accessible beyond this.<\/p>

2.5 The following languages are available for the conclusion of the contract: German.<\/span><\/p>

3. Right of withdrawal for consumers<\/h2>

Consumers generally have a right of withdrawal for contracts concluded outside of business premises and for distance selling contracts. A consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to their commercial or independent professional activity. Details can be found in the cancellation policy, which is provided to every consumer at the latest immediately before the conclusion of the contract.<\/p>

4. Payment, Default<\/h2>

4.1 The prices listed in the online shop at the time of order shall apply. All prices include statutory value-added tax and, where applicable, plus the shipping costs indicated. The customer will be informed of the available payment options in the provider's online shop.<\/p>

4.2 If payment via \u201ePayPal\u201c is agreed upon, the purchase price is due immediately after the contract is concluded. Payment processing is handled by the payment service provider PayPal (Europe) S.\u00e0 r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg.<\/p>

5. Retention of title<\/h2>

The purchased goods remain the property of the seller until full payment of the purchase price.<\/p>

6. Delivery and Reservation of Self-Supply<\/h2>

6.1 Subject to deviating agreements, delivery shall be made within the delivery time specified in the online shop to the delivery address provided by the customer. The applicable delivery times can be found in the online shop.<\/p>

6.2 Self-pickup of purchased goods is excluded.<\/p>

6.3 If the seller cannot deliver the ordered goods because they themselves were not supplied through no fault of their own, even though they entered into a congruent hedging transaction with a reliable supplier in good time, the seller shall be released from their obligation to perform and may withdraw from the contract. The seller is obliged to inform the customer immediately of the impossibility of fulfilling the service. Any counter-performance already rendered by the contractual partner will be reimbursed to them immediately. Mandatory consumer law remains unaffected by this paragraph.<\/p>

7. Warranty<\/h2>

The statutory warranty regulations apply.<\/p>

8. Liability and Indemnification<\/h2>

8.1 The provider is liable without limitation:<\/p>

  • for damages resulting from injury to life, body, or health caused by intentional or negligent breach of duty by the provider, or by intentional or negligent breach of duty by a legal representative or vicarious agent of the provider;<\/li>
  • for damages resulting from an intentional or grossly negligent breach of duty by the provider or an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of the provider;<\/li>
  • due to a warranty promise, provided that no other arrangement has been made in this regard;<\/li>
  • due to mandatory liability (e.g., under the Product Liability Act)<\/li><\/ul>

    8.2 If the provider negligently breaches a material contractual obligation, its liability shall be limited to the contractually typical, foreseeable damage, unless liability is unlimited as provided in the preceding paragraph. Material contractual obligations are obligations that the contract imposes on the provider according to its content for the purpose of achieving the contractual objective, the fulfillment of which enables the proper execution of the contract in the first place, and the observance of which the customer may regularly rely on.<\/p>

    8.3 Furthermore, liability of the provider, its vicarious agents, and legal representatives is excluded.<\/p>

    8.4 The customer indemnifies the provider against all third-party claims \u2013 including legal defense costs at their statutory rate \u2013 brought against the provider due to actions by the customer that are unlawful or in breach of contract.<\/p>

    9. Data Protection<\/h2>

    The provider treats customers' personal data confidentially and in accordance with statutory data protection regulations. For more details, please refer to the provider's privacy policy.<\/p>

    10. Final Provisions<\/h2>

    10.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods, provided that this choice of law does not deprive a consumer with habitual residence in the EU of mandatory legal provisions of the law of their country of residence.\u00a0<\/p>

    10.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the court at the provider's place of business shall have jurisdiction, unless an exclusive place of jurisdiction is established for the dispute. This shall also apply if the customer does not have a place of residence within the European Union. The seat of our company can be found in the heading of these GTC.<\/p>

    10.3 To the extent that any provision of this Agreement is invalid or unenforceable, or becomes invalid or unenforceable, the remaining provisions of this Agreement shall remain unaffected.<\/p>

    11. Information on online dispute resolution \/ consumer arbitration<\/h2>

    The provider is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.\u00a0<\/p>
